Delhi's New BJP Government Withdraws Legal Cases Against Lt Governor
In a significant move signaling the end of long-standing legal disputes between the Delhi government and the Lieutenant Governor (LG), the newly elected BJP-led administration has begun withdrawing several court cases, sources revealed on Wednesday.
Key Cases Being Withdrawn
Among the cases being retracted are legal disputes concerning:
The appointment of the Delhi Electricity Regulatory Commission (DERC) chairman.
Funding for the Delhi Jal Board.
The selection of lawyers in Delhi riots cases.
The training of teachers in foreign countries.
The high-level committee on Yamuna pollution.
AAP vs. LG: A Prolonged Political Battle
During its tenure, the Aam Aadmi Party (AAP) frequently clashed with successive Lieutenant Governors, including Najeeb Jung, Anil Baijal, and VK Saxena. The disagreements often escalated into legal battles, with AAP alleging that the LG was obstructing its policies. Conversely, the LGs accused the AAP government of non-cooperation.
This prolonged power struggle was one of the factors attributed to AAP’s significant defeat in the recent Delhi Assembly elections. The party was reduced to just 22 seats in the 70-member Assembly, while the BJP secured 48 seats, marking its return to power in the national capital after over 25 years. Chief Minister Rekha Gupta now leads the new BJP government.
Key Flashpoints in the Legal Dispute
DERC Chairman Appointment: AAP feared that allowing the Centre to control this regulatory body would result in the discontinuation of the power subsidy scheme, a major vote-winner.
Delhi Riots Cases: AAP accused the LG of interfering in the selection of public prosecutors, particularly in cases related to the 2020 Northeast Delhi riots.
Teacher Training in Finland: The LG had imposed conditions on sending Delhi’s teachers abroad for training, leading to a legal challenge by AAP.
Yamuna Pollution Committee: Disputes arose over the composition and authority of the high-level panel formed to address pollution in the Yamuna River.
New BJP Government’s Approach
Sources indicate that the withdrawal of these cases aims to resolve conflicts between the Delhi administration and the LG’s office. The new government seeks to prioritize governance over confrontations. A government source stated, "Governance will get priority."
The move is expected to foster a more cooperative relationship between the Delhi government and the Centre, potentially leading to smoother administration and policy implementation in the capital.
